Terms of service

1. The services

TEKYVA is an online software service (SaaS) for businesses. It includes, depending on your plan:

• Lead generation: landing pages, enquiry forms, short links and QR codes, webinars, e-book downloads and payments on pages.
• Lead management (CRM): leads, pipeline, follow-ups, applications and reports.
• Calendar and online bookings, online courses, a private community (discussion), training videos and a marketplace.
• AI tools such as AI Ad Writer and AI Brain.
• White-label branding for businesses, Black Label access for approved agencies, and a partner (referral) programme.

Features marked “Coming soon” on our website are not yet available and are not part of any plan until we announce them as live. We may improve, change or discontinue features; if we remove a major paid feature you rely on, we will give reasonable notice.

2. Accounts and security

• You must give accurate details and be at least 18 years old.
• Keep your password and one-time codes private. You are responsible for activity under your account and your team members’ accounts.
• The workspace owner controls who is invited, their roles and access, and can remove team members at any time.
• Tell us at once at admin@tekyva.in if you suspect unauthorised access.

3. Free trial, plans and payment

• New workspaces may get a free trial. Its length is shown on the pricing page. No card is needed to start a trial.
• Paid plans are billed in advance for the period you choose (for example 1, 3, 6 or 12 months). Prices are in Indian rupees; GST is added as applicable and shown before you pay.
• Payments are processed by Razorpay. We do not store your card or bank details.
• Plans do not renew automatically. Before your period ends we remind you to renew. If you don’t renew, the workspace becomes limited (read-only or paused) after any grace period shown in the app; your data is kept as described in our privacy policy.
• Add-ons (for example extra users, or the yearly AI Suite) are charged as shown in Plan & billing and on the AI Suite page.
• Plan limits (users, leads, pipelines and others) are shown in the app.
• We may change prices for future periods with at least 30 days’ notice; the price you have paid for a current period does not change.

Refunds and cancellations are covered by our refund & cancellation policy.

4. Your data and your customers’ data

You own the data you and your team put into TEKYVA, including your leads, students, bookings, pages and files (“Customer Data”). You give us permission to store and process Customer Data only to provide and support the services, keep them secure and meet legal obligations.

• For personal data of your leads, students and customers, you decide why it is collected and are the “Data Fiduciary” under the Digital Personal Data Protection Act, 2023. We process it on your behalf as a “Data Processor”.
• You are responsible for having a lawful basis and any consent needed to collect and contact people (including by phone, SMS, email and WhatsApp), and for showing your own privacy notice on your pages.
• You can export your leads at any time. Each workspace’s data is kept separate from other workspaces.

5. Acceptable use

You must not use TEKYVA to:

• Break any law, including consumer protection, advertising, data protection, telecom (TRAI/DLT) and spam rules.
• Collect data without permission, buy or rent contact lists for messaging, or send unsolicited bulk messages.
• Publish false, misleading, defamatory, obscene or hateful content, fake reviews or testimonials, or content that infringes others’ rights.
• Run phishing pages, collect passwords or payment details under false pretences, or impersonate another person or organisation.
• Upload malware, try to access other workspaces, probe or overload the service, or resell it without a Black Label agreement.

We may remove content or suspend a workspace that breaks these rules, usually after notice unless the risk is serious or the law requires otherwise.

6. Your pages, courses and payments

• When you sell to your own customers (for example a paid webinar, course or booking) using your Razorpay account, the sale is between you and your customer. You set the price, taxes, refund terms and deliver what you sell. TEKYVA provides the software only.
• Your pages must show your business name and contact details, and your own terms and refund policy where you sell.
• Videos you link from YouTube or Vimeo remain subject to those platforms’ terms.

7. AI tools

• AI Ad Writer and AI Brain use third-party AI models. The text you enter (and, for AI Ad Writer, the content of the page or course you choose) is sent to our AI provider to produce the answer. Do not enter personal or sensitive data that the tool doesn’t need.
• AI output can be wrong or incomplete. Check every ad and answer before using it. You are responsible for ads you publish and for following Google’s and Meta’s advertising policies.
• AI features (such as AI Ad Writer) need the AI Suite add-on and run on your own AI account (Anthropic or OpenAI API key, stored encrypted). Your AI company bills you directly for usage; we are not responsible for their charges or availability. AI Brain is free with a fair daily limit per person.

8. Marketplace

• The marketplace offers page templates and done-for-you services sold by TEKYVA or by approved partners. Each listing shows the seller, price (plus GST where applicable) and, for services, the delivery time.
• Payment for marketplace orders is collected by TEKYVA Business Solutions. For a partner’s listing, the partner delivers the service and TEKYVA Business Solutions pays the partner their share.
• Templates are licensed for use in your own workspace; you may not resell them as templates.
• Refunds for marketplace orders follow our refund & cancellation policy.
• Partners selling in the marketplace must deliver as described, keep buyers’ information confidential and follow these terms.

9. Black Label agencies and partners

• Approved agencies may offer TEKYVA to their own clients under their brand. The agency is responsible for its clients, pricing, billing and first-line support, under a separate agreement with us.
• Partners in the referral programme earn commission as described on the partner programme page. Partners never get access to their referred customers’ CRM data.

10. Our intellectual property

TEKYVA, its software, designs, templates and content belong to TEKYVA Business Solutions or its licensors. You get a limited, non-exclusive, non-transferable right to use the services during your subscription. Do not copy, reverse-engineer or create competing products from the services.

11. Availability and support

We work to keep TEKYVA available and secure, with regular backups, but we don’t guarantee it will be uninterrupted or error-free. Planned maintenance is done at low-traffic times where possible. Support is available through Remote support in the app and at admin@tekyva.in.

12. Disclaimers and limitation of liability

The services are provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits, lost business or lost data caused by events outside our reasonable control, or by third-party services (payment gateways, video platforms, email, messaging or AI providers).

Our total liability for any claim relating to the services is limited to the amount you paid us for the services in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

13. Ending the service

• You can stop using TEKYVA at any time; see the refund & cancellation policy for paid plans.
• We may suspend or close a workspace for serious or repeated breach of these terms, non-payment, or where the law requires it.
• After closure you can ask for an export of your leads within 30 days. After that, data is deleted as described in the privacy policy, except where we must keep it by law (for example invoices).

14. Governing law and disputes

These terms are governed by the laws of India. We will first try to resolve any dispute through discussion; write to admin@tekyva.in. Courts in Bengaluru, Karnataka have exclusive jurisdiction.

15. Changes to these terms

We may update these terms. We’ll post the new version here with its date and, for important changes, tell workspace owners by email or in the app at least 15 days before they apply. Continuing to use the services after that means you accept the updated terms.
